Overview

The City Council is composed of five Bogata city residents who are elected in at large elections held every two years. The council is led by the Mayor, also 5 city residents elected every two years. General elections are held on the second Saturday in May and are open to all eligible residents of the City. A Mayor Pro Tem is chosen by the council to preside in the event of the Mayor's absence.

Position Summary:

Under the guidance of the City Council and State Law, the Mayor is responsible for efficient/effective resource utilization and achieving quality outcomes. Leads others by assisting and guiding staff in decision-making. Maintains a positive working relationship with the City Council, staff, and other departments.

I. Powers and duties of the Mayor (Type A City):

  Local Government Code, Sec. 22.042. POWERS AND DUTIES OF MAYOR. (a) The mayor is the Chief Executive Officer of the municipality. The mayor shall at all times actively ensure that the laws and ordinances of the municipality are properly carried out. The mayor shall perform the duties and exercise the powers prescribed by the governing body of the municipality.

(b) The mayor shall inspect the conduct of each subordinate municipal officer (see Local Govt 22.071) and shall cause any negligence, carelessness, or other violation of duty to be prosecuted and punished.

(c) The mayor shall give to the governing body any information, and shall recommend to the governing body any measure, that relates to improving the finances, police, health, security, cleanliness, comfort, ornament, or good government of the municipality.

(d) The mayor may administer oaths of office.

(e) In the event of a riot or unlawful assembly or to preserve the peace and good order in the municipality, the mayor may order and enforce the closing of a theater, ballroom, or other place of recreation or entertainment, or a public room or building and may order the arrest of a person who violates a state law or a municipal ordinance in the presence of the mayor.

 II. The Mayor of the City of Bogata is authorized, by statute, to:

           1. preside over the meetings of the governing body.

           2. manage all Council meetings.

           3. is responsible for the conduct of the meeting in an orderly fashion.

           4. calls the agenda items in any order necessary.

           5. may be the parliamentarian during the meetings but has the primary responsibility

               to ensure that the meeting follows the Open Meetings Act of the State of Texas.

           6. does not have the authority to cancel meetings.

           7. may not vote unless there is a tie. (See Local Govt Code Section 22.037).

           8. The Mayor is also authorized to call special meetings on the Mayor’s own motion or

               on the application of three council members. (See Local Govt Code 22.038).

           9. The Mayor of a municipality serves as the Budget Officer for the governing body of

               the municipality.

 

III. Mayoral power and duties authorized by the City Council:

1.     Day to Day (routine) employment issues such as schedules, attendance, mandatory reports, performance of repetitive monthly/weekly tasks such as payroll.

2.     Interview and screening of applications for employment and recommendations to the City Council for employment or further interview.

3.     Based on articulable facts which constitute a harm or risk to life or property, the Mayor may suspend an employee until action by the Personnel Committee.

4.     Service along with two other elected Council persons as the personnel committee. The Committee is exclusively responsible for discipline, grievances, involving the City department heads. The Committee determines the nature and scope of the investigation and may delegate certain duties. An employee may appeal a decision of the Personnel committee to the full City Council.

5.     Spend up to $5000.00 on a project or circumstance without prior approval of the City Council but, has the obligation to account for the expenses at the following Council meeting.

6.     Negotiate settlements/ contracts/ agreements with 3rd parties, but cannot bind

            the City without Council approval.

7.     Report monthly to the Council on the performance of these duties.
